May 11, 2009

 

The Regular Board Meeting of the Town Board of the Town of Royalton was held on Monday, May 11, 2009, at the Royalton Town Hall, 5316 Royalton Center Road, Middleport, New York. The meeting was called to order by Supervisor Richard J. Lang at 7:30 PM. The Pledge to the Flag was recited at the Public Hearing held immediately preceding this meeting.

There were no additions or corrections to the minutes as presented.

 

PUBLIC COMMENT

There was no public comment to come before the board at this time.

 

COMMUNICATIONS

Town Clerk Little introduced Ms. Jill Seelbinder who has been hired as the Deputy Town Clerk 2. A round of applause was held for Ms. Seelbinder.

RESOLUTION 58-09

LOCAL LAW # 1 FOR 2009 - ESTABLISHMENT OF FIVE (5) MEMBER BOARD OF ASSESSMENT REVIEW

On a motion made by Councilman Bragg, seconded by Councilman Budde, the following was

ADOPTED AYES 5 Lang, Bieber, Bragg, Budde, Rehwaldt

               NAYS 0 MOTION CARRIED

 

Resolved to adopt the Local Law Number One for the year 2009 for the Town of Royalton regarding the Establishment of a Five (5) Member Board of Assessment Review as provided for in Subdivision 1 (b) of Section 523 of the Real Property Tax Law.

BOARD OF ASSESSMENT REVIEW APPOINTMENTS

On a motion made by Councilman Budde, seconded by Councilwoman Bieber, the following was

Resolved to appoint the following two (2) individuals to the Board of Assessment Review. The terms of office will be as follows:

Lee Criswell 05/12/2009 - 09/30/2011

Daniel Conley 05/12/2009 - 09/30/2014

 

RESOLUTION 60-09

MUNICIPAL AGREEMENT WITH THE VILLAGE OF MIDDLEPORT FOR POLICE CONTRACT

On a motion made by Councilwoman Bieber, seconded by Councilman Bragg, the following was

ADOPTED AYES 5 Lang, Bieber, Bragg, Budde, Rehwaldt

               NAYS 0 MOTION CARRIED

 

Resolved to authorize Supervisor Richard J. Lang to sign the Municipal Cooperation Agreement between the Village of Middleport and the Town of Royalton for the police force to perform services within the Town of Royalton. The contract dates and terms are as follows:

 

June 1, 2009 - May 31, 2010 $35,847.55 / year - $2,987.30 / month

June 1, 2010 - May 31, 2011 $37,281.45 / year - $3,106.79 / month

June 1, 2011 - May 31, 2012 $38,772.71 / year - $3,231.71 / month

 

RESOLUTION 61-09

CEMETERY MOWING CONTRACT AWARDS

On a motion made by Councilman Rehwaldt, seconded by Councilwoman Bieber, the following was

ADOPTED AYES 5 Lang, Bieber, Bragg, Budde, Rehwaldt

               NAYS 0 MOTION CARRIED

 

Resolved to award the cemetery mowing contracts to Hausrath's Landscape Maintenance, 451 Meyer Road, Amherst, NY 14226. The price for the Royalton Mountain Ridge Cemetery will be $8,400.00 for 2009. The price for the three (3) small cemeteries will be $1,350.00 for 2009.

 

The four (4) bids that were received are as follows:

RESOLUTION 62-09

WOLCOTTSVILLE VOLUNTEER FIRE COMPANY - NEW MEMBERS AND MEMBER RESIGNATION

On a motion made by Councilwoman Bieber, seconded by Councilman Bragg, the following was

Resolved to accept the following individuals in to membership of the Wolcottsville Volunteer Fire Company:

  3. David Graham - Regular Member
  4. Debbie Graham - Regular Member
  5. Aaron Criswell - Regular Member
  6. Blaine Keyes - Regular Member
  7. Maline Le - Regular Member

 

BE IT FURTHER RESOLVED to accept the Resignation of Bryan Schaffer as a Regular Member of the Wolcottsville Volunteer Fire Company and to have him removed from the insurance rolls for the Town of Royalton.

 

RESOLUTION 63-09

DRIVEWAY AGREEMENT

On a motion made by Councilman Bragg, seconded by Councilman Rehwaldt, the following was

               NAYS 0 MOTION CARRIED

 

Resolved to authorize Supervisor Richard J. Lang to execute the Driveway Agreement, based on Legal Counsels recommendation, for the property owned by Ms. Susan Dickinson which is located at 4253 Royalton Center Road, Gasport, New York. (Copy of agreement to be included in Town Clerk Minutes Book.)

 

RESOLUTION 64-09

PUBLIC HEARING FOR TOWN OF ROYALTON COMPREHENSIVE PLAN

On a motion made by Councilwoman Bieber, seconded by Councilman Rehwaldt, the following was

ADOPTED AYES 5 Lang, Bieber, Bragg, Budde, Rehwaldt

               NAYS 0 MOTION CARRIED

 

Resolved to set a Public Hearing date for Wednesday, May 27, 2009 at 7:00 PM to hear and consider the final plans for the Town of Royalton Comprehensive Plan.

 

RESOLUTION 65-09

RESIGNATION OF PLANNING BOARD MEMBER

On a motion made by Councilman Rehwaldt, seconded by Councilman Budde, the following was

ADOPTED AYES 5 Lang, Bieber, Bragg, Budde, Rehwaldt

               NAYS 0 MOTION CARRIED

 

Resolved to accept the resignation of Mary Cedeno from the Town of Royalton Planning Board.

(Town Clerk Little read the formal letter received by Supervisor Lang.)

 

RESOLUTION 66-09

HIRING OF NEW CONFIDENTIAL SECRETARY TO THE SUPERVISOR

On a motion made by Councilman Budde, seconded by Councilman Bragg, the following was

ADOPTED AYES 5 Lang, Bieber, Bragg, Budde, Rehwaldt

               NAYS 0 MOTION CARRIED

 

Resolved to authorize Supervisor Richard J. Lang to hire Ms. Darlene Schwarzkopf as the Confidential Secretary to the Supervisor, effective May 15, 2009.

 

RESOLUTION 67-09

NYSERDA LIGHTING UPGRADES AT THE WASTE WATER TREATMENT PLANT

On a motion made by Councilman Bragg, seconded by Councilman Rehwaldt, the following was

ADOPTED AYES 5 Lang, Bieber, Bragg, Budde, Rehwaldt

               NAYS 0 MOTION CARRIED

 

Resolved to accept the low bid of $3,700.00 received from Gregory M. Nellist, Industrial Electrical Contracting, to perform the suggested lighting upgrades at the Waste Water Treatment Plant, as per the NYSERDA Energy Audit.

 

The two (2) written quotes that were submitted for this project are as follows:

  1. Gregory M. Nellist, Industrial Electrical Contracting $3,700.00
  2. Marotta Electric $4,195.00

 

RESOLUTION 68-09

AUDIT OF CLAIMS

On a motion made by Councilman Budde, seconded by Councilman Bragg, the following resolution was

ADOPTED AYES 5 Lang, Bieber, Bragg, Budde, Rehwaldt

               NAYS 0 MOTION CARRIED

 

Resolved that the Town Clerk be and she hereby is authorized to draw a warrant upon the funds of the Supervisor in the amount of $135,225.41 covering vouchers #390-478 for Abstract #5 for the year 2009 for the Town Hall, Highway Department and the Water / Sewer Department.

 

UNFINISHED BUSINESS

Ms. Donna Nieman asked the Town Board if we gave any money to Tom Brigham for the baseball league. Supervisor Lang stated that we gave them $2,100.00 for their 2009 season. Ms. Nieman stated that she knows money is tight, but asked if we could give the Middleport Library more money next year as it is the lone library that serves our community. Supervisor Lang thanked her for her comments.

 

PUBLIC COMMENT - GOOD & WELFARE OF THE COMMUNITY

There being no further information to come before this board, a motion was made by Councilwoman Bieber, seconded by Councilman Rehwaldt and carried unanimously that the meeting be adjourned at 7:40 PM.
