The Regular Board Meeting of the Town Board of the Town of Royalton was held on Monday, September 14, 2009, at the Royalton Town Hall, 5316 Royalton Center Road, Middleport, New York.  The meeting was called to order by Supervisor Richard J. Lang at 7:30 PM with the Pledge to the Flag.

RESOLUTION 91-09

BOARD OF ASSESSMENT REVIEW APPOINTMENT

On a motion made by Councilman Bragg, seconded by Councilman Budde, the following was

 ADOPTED         AYES  5          Lang, Bieber, Bragg, Budde, Rehwaldt

                        NAYS 0           None                            MOTION CARRIED

Resolved to re-appoint Michael Drum to the Board of Assessment Review for the Town of Royalton.  The term of office will run from October 1, 2009 through September 30, 2014.

RESOLUTION 92-09

LINE ITEM TRANSFER

On a motion made by Councilman Rehwaldt, seconded by Councilwoman Bieber, the following was

                        NAYS 0          None                            MOTION CARRIED

Resolved to authorize Supervisor Richard J. Lang to make a line item transfer from account SL5182.4-Lighting District, Contractual to account B5182.4-Street Lighting, Contractual in the amount of $2,873.45.  This transfer is required to correct an overpayment made by the "B Fund" Street Lighting account for services rendered for the Lighting District

On a motion made by Councilwoman Bieber, seconded by Councilman Bragg, the following was

Resolved to accept the amendment to the Bingo License for Terry's Corners Volunteer Fire Company to include the new members that were accepted in to membership at the August board meeting.

SMALL CLAIM ASSESSMENT REVIEW

On a motion made by Councilman Bragg, seconded by Councilman Rehwaldt, the following was

Resolved to authorize Supervisor Richard J. Lang to issue a check in the amount of $30.00 to Mr. Scott Garbutt for his Small Claims Assessment Review decision, due to an excessive assessment suit.

EAST AVENUE BRIDGE, GASPORT - PLAN OF ACTION

On a motion made by Councilman Bragg, seconded by Councilman Budde, the following was

Resolved to authorize TVGA Engineers to prepare a Plan of Action for the Scour Critical Bridge on East Avenue in Gasport.

REJECTION OF BID - GRINDER PUMP STATION PROJECT

On a motion made by Councilman Budde, seconded by Councilwoman Bieber, the following was

Resolved to reject the one (1) lone bid received from Milherst Construction for the Grinder Pump Station Project in the amount of $64,500.00.  This project will be reviewed by TVGA to investigate other alternatives prior to re-bidding it.

FISK ROAD - 10-TON LOAD LIMIT

On a motion made by Councilman Bragg, seconded by Councilman Rehwaldt, the following was

Resolved to authorize Highway Superintendent Terry Nieman, to post Fisk Road from Route 93 to Ditch Road as a 10-ton load limit maximum road. 

RESOLUTION 98-09

RAPIDS VOLUNTEER FIRE COMPANY 75TH ANNIVERSARY

On a motion made by Councilman Rehwaldt, seconded by Councilwoman Bieber, the following was

ADOPTED          AYES  5          Lang, Bieber, Bragg, Budde, Rehwaldt

                        NAYS 0          None                            MOTION CARRIED

Resolved to authorize Supervisor Richard J. Lang to issue a check in the amount of $25.00 for a quarter (1/4) page ad from the Royalton Town Board for the 75th Anniversary Installation of Officers Program for the Rapids Volunteer Fire Company.  This amount will be paid out from the Central Printing line item (A1670.4).

RESOLUTION 99-09

AUDIT OF TOWN JUSTICE COURT RECORDS

On a motion made by Councilwoman Bieber, seconded by Councilman Rehwaldt, the following was

Resolved that the 2009 second quarter court records for the two (2) Town of Royalton Justice Courts have been examined by the Town of Royalton Town Board Members.  The board members verification form will be submitted to the NYS Office of Court Administration for this audit. 

RESOLUTION 100-09

TERRY'S CORNERS VOLUNTEER FIRE COMPANY - NEW MEMBER

On a motion made by Councilman Bragg, seconded by Councilman Budde, the following was

Resolved to accept Mr. Daniel Yotter in to membership of the Terry's Corners Volunteer Fire Company.

RESOLUTION 101-09

AUDIT OF CLAIMS

On a motion made by Councilman Rehwaldt, seconded by Councilman Bragg, the following resolution was

ADOPTED          AYES  5          Lang, Bieber, Bragg, Budde, Rehwaldt

                        NAYS 0          None                            MOTION CARRIED

Resolved that the Town Clerk be and she hereby is authorized to draw a warrant upon the funds of the Supervisor in the amount of $461,820.50 covering vouchers #841-993 for Abstract #9 for the year 2009 for the Town Hall, Highway Department and the Water / Sewer Department. 

UNFINISHED BUSINESS

There was no unfinished business to come before the board at this time. 

PUBLIC COMMENT - GOOD & WELFARE OF THE COMMUNITY

Attorney Thomas Brandt stated that he had his daughter here in the audience with him this evening for her government class.  She is required to report back on the public comment section of the meeting.  Mr. Brandt stated that he would appreciate it if someone would ask a question so that she could finish her assignment.

Supervisor Lang asked where people will be voting tomorrow in the Primary Election.  Town Clerk Little advised those in attendance at this meeting of the four (4) locations set up for the six (6) districts in the Town of Royalton.  Town Clerk Little stated that we are participating in the Pilot Program this year and we will be using the new electronic scanners for voting in the 2009 elections. 

Ms. Donna Nieman asked what projects we are working on right now.  Deputy Supervisor Bieber stated that we are working on the 2010 budget right now. Supervisor Lang stated that we are working on the Grinder Pump Station Project and we have applied for a grant for Waste Water Management. 

Councilwoman Bieber stated that there will be a Defensive Driving Course here at the town hall on Saturday, October 3, 2009 from 9:00 AM-3:15 PM.  The cost will be $24.00 for pre-registration and $29.00 the day of the class.  There is a limit of forty (40) persons for this class and it is first come, first served. 

Councilman Rehwaldt stated that we are finishing up the NYSERDA projects so that we can get our rebates back from New York State. 

Mrs. Molly McGirr asked if the first meeting had been set for the first budget meeting.  Supervisor Lang stated that he just received all the information from the department heads to put it together.  The meeting information will be posted on the town website and will be furnished to the Lockport Union Sun & Journal.

Mr. Lester Bower asked if we had officially taken over the Royalton Union Cemetery yet.  Deputy Supervisor Bieber stated that it is not official as of yet.  Town Clerk Little stated that it is in the works and will be turned over soon. 

There being no further information to come before this board, a motion was made by Councilwoman Bieber, seconded by Councilman Rehwaldt and carried unanimously that the meeting be adjourned at 7:40 PM.
