October 19, 2009

 

The Regular Board Meeting of the Town Board of the Town of Royalton was held on Monday, October 19, 2009, at the Royalton Town Hall, 5316 Royalton Center Road, Middleport, New York. The meeting was called to order by Supervisor Richard J. Lang at 7:30 PM with the Pledge to the Flag.

 

The following were present:

Highway Superintendent Terry Nieman

Water/Sewer Superintendent Daniel Morse

PUBLIC COMMENT

Mrs. Molly McGirr asked for clarification regarding the resolution pertaining to the LaFarge lawsuit. Attorney Brandt explained what is entailed in the settlement. Mr. Brandt stated that LaFarge had brought lawsuits for the past two (2) years challenging their assessments. We have agreed to settle these two (2) lawsuits. They were assessed for $800,000.00 for all of their parcels and we have settled for a $625,000.00 assessment. There will be no refunds for the year 2008 and there will be a school refund for the year 2009. Attorney Brandt stated that the litigation will be resolved and there will be no lawsuits for the next three (3) years as part of the settlement. The total impact to the Town of Royalton will be approximately $1,000.00.

 

COMMUNICATIONS / PETITIONS

Town Clerk Little read a "Thank You" card from the Gasport Beautification Committee for the Water Department's help with the placement and removal of the barrels along Main Street in Gasport for their barrel contest.

 

NEW BUSINESS

RESOLUTION 103-09

PUBLIC HEARING - OUTDOOR WOOD BOILERS

On a motion made by Councilman Budde, seconded by Councilman Bragg, the following was

ADOPTED AYES 5 Lang, Bieber, Bragg, Budde, Rehwaldt

              NAYS 0 None                      MOTION CARRIED

Resolved to set the date for a Public Hearing regarding the Outdoor Wood Boilers for Monday,

December 14, 2009 at 7:15 PM.

 

RESOLUTION 104-09

RE-BID TELEGRAPH ROAD PUMP STATION PROJECT

On a motion made by Councilwoman Bieber, seconded by Councilman Rehwaldt, the following was

ADOPTED AYES 5 Lang, Bieber, Bragg, Budde, Rehwaldt

              NAYS 0 None                      MOTION CARRIED

Resolved to authorize TVGA, Town Engineers, to re-bid the Telegraph Road Pump Station Project with revised bid specifications, to be configured and provided by TVGA. 

 

RESOLUTION 105-09

LINE ITEM TRANSFER - SEWER

On a motion made by Councilman Rehwaldt, seconded by Councilwoman Rehwaldt, the following was

ADOPTED AYES 5 Lang, Bieber, Bragg, Budde, Rehwaldt

               NAYS 0 None                     MOTION CARRIED

Resolved to authorize a line item transfer FROM SS8120.2 - Sewage Collection, Equipment, TO SS8120.4 - Sewage Collection, Contractual, in the amount of $3,180.41 to cover the cost for the engineering fees associated with the Telegraph Road Grinder Pump Station project to date.

 

RESOLUTION 106-09

LINE ITEM TRANSFER - CENTRAL PRINTING

On a motion made by Councilman Bragg, seconded by Councilman Budde, the following was

Resolved to authorize a line item transfer FROM A1670.4-Central Printing, Contractual, TO SW8310.4-Water Administration, Contractual, in the amount of $2,504.52 to cover the cost of postage to mail the water bills for 2009.

 

RESOLUTION 107-09

LAWSUIT SETTLEMENT - LAFARGE

On a motion made by Councilwoman Bieber, seconded by Councilman Rehwaldt, the following was

ADOPTED AYES 5 Lang, Bieber, Bragg, Budde, Rehwaldt

               NAYS 0 None                     MOTION CARRIED

Resolved to authorize Thomas H. Brandt, Town Attorney, to go to court to formally settle the LaFarge lawsuit on behalf of the Town of Royalton.

 

RESOLUTION 108-09

AUDIT OF CLAIMS

On a motion made by Councilman Bragg, seconded by Councilman Budde, the following resolution was

ADOPTED AYES 5 Lang, Bieber, Bragg, Budde, Rehwaldt

               NAYS 0 None                     MOTION CARRIED

Resolved that the Town Clerk be and she hereby is authorized to draw a warrant upon the funds of the Supervisor in the amount of $231,469.37 covering vouchers #994 - 1139 for Abstract #10 for the year 2009 for the Town Hall, Highway Department and the Water / Sewer Department.

 

UNFINISHED BUSINESS

There was no unfinished business to come before the board at this time.

 

PUBLIC COMMENT - GOOD & WELFARE OF THE COMMUNITY

Mr. Lester Bower questioned the load limit for Lincoln Avenue. Mr. Bower stated that the road used to be posted as a 10-ton load limit. Mr. Terry Nieman, Highway Superintendent, stated that it should still be listed as a 10-ton weight limit. Mr. Nieman stated that he will look in to this matter and make sure that the proper signage is installed. Mr. Nieman suggested that the Town Board members write a letter of concern to the State Police regarding these concerns for enforcement of the posted 10-ton weight limits on our town roads. There are issues on many of our roads that are posted but still being used by the larger trucks. There are no police agencies enforcing the load limit laws at this time.

 

There being no further information to come before this board, a motion was made by Councilman Bragg, seconded by Councilwoman Bieber and carried unanimously that the meeting be adjourned at 7:40 PM.
