REGULAR BOARD MEETING

April 12, 2010

 

The Regular Board Meeting of the Town Board of the Town of Royalton was held on Monday, April 12, 2010, at the Royalton Town Hall, 5316 Royalton Center Road, Middleport, New York. The meeting was called to order by Supervisor Richard J. Lang at 7:30 PM.  The Pledge to the Flag was recited at the Public Hearing immediately preceding this meeting.

ADDITIONS OR CORRECTIONS TO THE MINUTES

There were no additions or corrections to be made to the minutes as presented by the Town Clerk.

 

PUBLIC COMMENT

Mr. Scott Wymczak addressed the board regarding the resolution concerning the health care. Mr. Wymczak stated that he thought all of our health care insurance was purchased through the Teamsters. Attorney Brandt stated that this resolution has to do with the retiree's health care plans.

 

COMMUNICATIONS / PETITIONS

Town Clerk Little read a communication from the Cambria Congregational Church inviting everyone to a "National Day of Prayer Service" to be held on May 6, 2010 at 7 PM at 4045 Lower Mountain Road, Lockport.

 

Town Clerk Little read a flier regarding the upcoming Free CPR/First Aid Training Class that will be held at the Wolcottsville Volunteer Fire Company this Saturday, April 17, 2010. There are currently 85 people signed up or this event. This class is being sponsored by Rural Metro Ambulance and is FREE to all residents of the Town of Royalton. Anyone interested in attending is asked to register on-line at www.wolcottsvillefire.com

 

Town Clerk Little read a flier from the Gasport Beautification Committee regarding the date for "Clean Up Gasport". This year it will be held on Saturday, May 1, 2010, at 9:00 AM. Anyone interested in helping out should meet at Zion Church and is asked to bring gloves, trimmers, rakes, garbage bags, and any additional garden tools you think will be helpful.

RESOLUTION 57-10

LOCAL LAW NO. 1 FOR THE YEAR 2010 - OUTDOOR BOILERS

On a motion made by Councilman Bragg, seconded by Councilman Rehwaldt, the following resolution was

Resolved to adopt Local Law No. 1 for the year 2010 pertaining to the rules and regulations for Outdoor Boilers. (A copy of this Local Law will be attached to these minutes.)

NYS DOT - SPEED LIMIT SIGNS

On a motion made by Councilman Bragg, seconded by Councilwoman Bieber, the following resolution was

Resolved to submit a letter to the New York State Department of Transportation (NYS DOT) to request that they install additional speed limit signs prior to approaching the school zone on Route 31 by the Gasport Elementary School.

NYS DOT - SPEED REDUCTION ON ROUTE 31

On a motion made by Councilwoman Bieber, seconded by Councilman Rehwaldt, the following resolution was

Resolved to submit a TE-9 form to the New York State Department of Transportation (NYS DOT) to request a speed reduction on Route 31 from Fairview Drive to Bolton Road from 55 MPH down to 45 MPH.

On a motion made by Councilwoman Bieber, seconded by Councilman Bragg, the following resolution was

Resolved to increase the Zoning/Permit Fees as listed:

Minimum Permit Fee $ 25.00

Permit Renewals $ 25.00 or 10% (whichever is >)

Agricultural Uses $ 25.00 flat fee

Certificate of Compliance/Conformance $ 25.00

Woodstove Inspection (existing) $ 25.00

Variance Application $125.00

Temporary Use Permit (TCUP) Application $100.00

TCUP Renewal $ 25.00 / year

Special Use Permit Application $125.00

 

RESOLUTION 61-10

PUBLIC HEARING - LOCAL LAW NO. 2 FOR THE YEAR 2010 - FLOOD DAMAGE PREVENTION

On a motion made by Councilman Rehwaldt, seconded by Councilman Bragg, the following resolution was

Resolved to call for a Public Hearing on May 10, 2010 @ 7:15 PM to hear and consider information pertaining to the Local Law regarding Flood Damage Prevention. 

 

RESOLUTION 62-10

FOOTE ROAD CHANGES

On a motion made by Councilman Rehwaldt, seconded by Councilman Bragg, the following resolution was

ADOPTED AYES 4 Lang, Bieber, Bragg, Rehwaldt

               NAYS 0 None                     MOTION CARRIED

Resolved to authorize the implementation of "Option 2" as stated in the "Road Width Analysis" report provided by TVGA Consultants on March 25, 2010 concerning making Foote Road a one-way roadway. Estimated Design and Construction cost of $50,000.00. (Option 1 = $1.5 - $2.0 million, Option 1A = $2.5 - $3.0 million)

ADVERTISE FOR BIDS - HOLLENBECK ROAD BRIDGE

On a motion made by Councilman Bragg, seconded by Councilman Rehwaldt, the following resolution was

Resolved to authorize Terry Nieman, Highway Superintendent, to advertise for bids to rehabilitate the Hollenbeck Road Bridge.

MOWING OF ROYALTON UNION CEMETERY

On a motion made by Councilwoman Bieber, seconded by Councilman Bragg, the following resolution was

Resolved to award the mowing bid for the Royalton Union Cemetery to Hausrath's Landscape Maintenance, Inc. at a

cost not to exceed $1,850.00. The four (4) bids received are as follows:

Resolved to authorize a line item transfer FROM A1620.4 - Buildings & Grounds, Contractual line, TO A1620.2 - Buildings and Grounds, Equipment line in the amount of $15,776.16 to cover the cost of the new Commercial Front Mower.

On a motion made by Councilwoman Bieber, seconded by Councilman Bragg, the following resolution was

Resolved to call upon the New York State Legislature to adopt and the Governor to sign legislation which would allow credit unions, savings banks, and savings and loan associations to accept and secure deposits from municipal corporations, school districts, and fire districts. (A copy of this resolution will be forwarded to Governor David Patterson, Senator George Maziarz, and Assemblywoman Jane Corwin.)

RIDE FOR ROSWELL

On a motion made by Councilman Rehwaldt, seconded by Councilman Bragg, the following resolution was

Resolved to authorize the "Ride for Roswell" to utilize the town roads and the Town Hall parking lot for their annual bike ride to be held on June 26, 2010 between 7:00 AM and 3:00 PM.

On a motion made by Councilman Rehwaldt, seconded by Councilwoman Bieber, the following resolution was

Resolved to authorize Daniel Morse, Water/Sewer Superintendent, to advertise for bids on the following pieces of used equipment from his department:

One (1) 1996 4X2 Ford F250 Pickup Truck with 8 ft. Stahl Utility Box, 5.8L engine with 122,000 miles

One (1) 1997 F932 John Deer Mower with 72" Deck - 1,730 hours

 

RESOLUTION 70-10

BOWER INSURANCE AGENCY

On a motion made by Councilman Bragg, seconded by Councilman Rehwaldt, the following resolution was

Resolved to authorize the Bower Agency to act on behalf of the Town of Royalton to obtain insurance quotes for the

Town of Royalton health insurance.

 

RESOLUTION 71-10

COURT ROOM RENOVATION PROJECT

On a motion made by Councilwoman Bieber, seconded by Councilman Rehwaldt, the following resolution was

ADOPTED AYES 4 Lang, Bieber, Bragg, Rehwaldt

               NAYS 0 None                     MOTION CARRIED

Resolved to award the bid for the Court Room Renovation Project to Mr. Ronald Sprout at a cost not to exceed $41,000.00.

There were two (2) bids received for this project:

Mr. Ronald Sprout, Freeman Road, Middleport, NY  $41,000.00

R.B. Mac Construction Co., Inc., Lockport, NY        $73,500.00

 

RESOLUTION 72-10

AUDIT OF CLAIMS

On a motion made by Councilwoman Bieber, seconded by Councilman Rehwaldt, the following resolution was

ADOPTED AYES 4 Lang, Bieber, Bragg, Rehwaldt

               NAYS 0 None                     MOTION CARRIED

Resolved that the Town Clerk be and she hereby is authorized to draw a warrant upon the funds of the Supervisor in the amount of $417,788.17 covering vouchers #358-536 for Abstract #4 for the year 2010 for the Town Hall, Highway Department and the Water /Sewer Department.

 

UNFINISHED BUSINESS

There was no unfinished business to come before the board at this time.

 

PUBLIC COMMENT - GOOD & WELFARE OF THE COMMUNITY

Mr. Scott Wymczak asked about the windmills and what is going on with that. Mr. Wymczak stated that there seems to be a lot of information in the Work Session minutes. Supervisor Lang stated that it is 100% reimbursement from the Stimulus Monies.

 

There being no further information or discussion to come before this board, a motion was made by Councilwoman Bieber, seconded by Councilman Rehwaldt and carried unanimously that the Regular Board Meeting be adjourned at 7:42 PM.
