REGULAR BOARD MEETING                                                      

December 13, 2010

The Regular Board Meeting of the Town Board of the Town of Royalton was held on Monday, December 13, 2010, at the Royalton Town Hall, 5316 Royalton Center Road, Middleport, New York.  The meeting was called to order by Supervisor Richard J. Lang at 7:30 PM with the Pledge to the Flag.

Richard Lang introduced Pat Hinds as the new part time Deputy Town Clerk.

There were no additions or corrections to be made to the minutes as presented by the Town Clerk. 

PUBLIC COMMENT - AGENDA ITEMS

There was no public comment regarding agenda items to come before the town board at this time.

COMMUNICATIONS / PETITIONS

Richard Lang, Supervisor read the notice from the International Institute of Municipal Clerks sent to the Town stating that Marie Little (CMC) has received the distinguished award of Certified Municipal Clerk (CMC)., and we commended her for this honorable award.

RESOLUTION 167-10

MODERN DISPOSAL SERVICES, INC.

To authorize Supervisor Richard J. Lang to enter into an agreement with Modern Disposal Services, Inc. to extend our current Refuse and Recycling Collection Contract for the period of January 1, 2011 - December 31, 2013.

On a motion made by Councilman Budde, seconded by Councilman Rehwaldt, the following was

RESOLUTION 168-10

THREE (3) YEAR CONTRACT WITH THE FIVE (5) TOWN OF ROYALTON  FIRE COMPANIES

To authorize Supervisor Richard J. Lang to enter into a three (3) year contract with the five (5) Town of Royalton Fire Companies.  Contract dates to run from January 1, 2011 - December 31, 2013.

On a motion made by Councilman Budde, seconded by Councilwoman  Bieber, the following was

RESOLUTION 171-10

TERRY'S CORNERS EXPANSION

Resolution to authorize Terry's Corners Volunteer Fire Company to an expansion to the existing fire hall by using the proceeds of a loan made by the Bank of Evans in the amount of $1.2 million.

On a motion made by Councilman Budde seconded by Councilman Rehwaldt, the following was

RESOLUTION 172-10

TRANSFER OF FUNDS FROM DB5110.1 TO DB5142.4

Resolution to authorize to authorize a line item transfer from DB5110.1 to DB5142.4 in the amount of  $30,000.  Transfer is to cover the cost of salt.

On a motion made by Councilwoman Bieber, seconded by Councilman Budde, the following was

UNFINISHED BUSINESSS

           

PUBLIC COMMENT - GOOD & WELFARE OF THE COMMUNITY

Mr. Scott Wymczak presented paperwork regarding law for workers comp.  Tom has and will review and will make a comment later.

Councilwoman Bieber mentioned that we are taking up a collection of can goods and unwrapped toys that may be put in the collection barrel in the hallway.  Collection of  these items is being taken thru December 22, 2010.

Thomas Brant has a resolution for bridge construction capital reserve fund ($1 Million).  We establish a capital reserve fund for future repairs and improvements to the bridges and accumulate moneys from time to time and you set a limit that the fund can have.  The supervisor is advised to keep the funds in a separate account.  Councilman Budde is in favor of this so that when we need funds they would be available.  This would create the frame work for this account that doesn't obligate us to put funds in.  No expenditures will be made from this fund without authorization for board to remove funds.

RESOLUTION 175-10

ESTABLISHING THE "BRIDGE CONSTRUCTION AND REPAIR FUND OF THE TOWN OF ROYALTON" UNDER SECTION 6-C OF THE GENERAL MUNICIPAL LAW

The Town Board of the Town of Royalton, duly convened in regular session, does hereby resolve as follows:

SECTION 1.  That there be and hereby is established a capital reserve fund for the future repairs to or improvement of the bridges in the Town of Royalton.

SECTION 2.  It is the intent of this Town Board to accumulate all/part of the cost of constructing and repairing bridges in the Town of Royalton, the maximum cost of which is estimated to be $1 Million.

SECTION 3.  The Supervisor is hereby directed to deposit moneys of this reserve fund in a separate bank account to be known as the "BRIDGE CONSTRUCTION AND REPAIR RESERVE FUND OF THE TOWN OF ROYALTON."

SECTION 4.  The Supervisor is authorized to invest, from time to time, the moneys of this fund in a separate bank account pursuant to section 6-F of the General Municipal Law.

SECTION 5.  No expenditure shall be made except upon authorization of this Board.

SECTION 6.  FUTHER RESOLVED, that this resolution is subject to a permissive referendum as provided by section 6-C of the General Municipal Law.

There being no further information to come before this board, a motion was made by Councilman Rehwaldt, seconded by Councilman Budde and carried unanimously that the Regular Board Meeting be adjourned at 7:42 PM.
