SPECIAL BOARD MEETING                                                                                                                                          

April 4, 2008

A Special Meeting of the Town Board of the Town of Royalton was held on Friday, April 4 10, 2008, at the Royalton Town Hall, 5316 Royalton Center Road, Middleport, New York.  The meeting was called to order by Supervisor

Richard J. Lang at 9:15 AM.

The purpose of this Special Meeting was to rescind the Town Board Resolution #20-08 - Designation of CPA Firm for the Year-End Audit and to hire a new accounting firm to prepare the 2007 AUD Report and to provide accounting services to the Town of Royalton.

RESOLUTION 57-08

RESCIND RESOLUTION 20-08 FOR ACCOUNTING FIRM

On a motion made by Councilwoman Bieber, seconded by Councilman Rehwaldt, the following was

Resolved to rescind RESOLUTION 20-08:  DESIGNATION OF CPA FIRM FOR YEAR-END AUDIT

Resolution read as follows:  Resolved to designate Lumsden & McCormick, LLP, CPA's to conduce the end of year audit for the Town of Royalton.

RESOLUTION 58-08

HIRING OF NEW ACCOUNTING FIRM - BERRY & BERRY, CPA's

On a motion made by Councilman Rehwaldt, seconded by Councilwoman Bieber, the following was

Resolved to authorize Supervisor Richard J. Lang to enter in to a contract with Berry & Berry, Certified Public Accounts, to provide accounting services to the Town of Royalton.  As per the written contract, Berry & Berry will prepare and file the 2007 AUD at a cost of $4,000.00.  The charge for 2008 & 2009 will be $8,000.00 per year, billed quarterly.  The fee will cover the preparation of the AUD, quarterly and annual reports, monitoring of our bookkeeping activity throughout the year, consultation with town employees, technical support, and budgetary assistance. 

Deputy Supervisor Bieber asked if Berry & Berry would assist us in any court matters, should the need arise.  Discussion ensued regarding this matter. 

Ms. Molly McGirr asked how the two firms compare cost-wise.  Supervisor Lang stated that it is about $4,000.00 less per year.  Discussion ensued regarding this matter. 

Deputy Supervisor Bieber read a memo from Mr. Tom Arlington, Assessor, regarding property located at 8101 State Street in Gasport.  The property has been in a state of disrepair for several years.  Mr. Arlington was notified by a neighbor in the area that the vibration from the increased train traffic has caused bricks to fall away from the front of the building.   

Discussion ensued regarding this matter.  Digital pictures of the area in question were presented to the board. 

RESOLUTION 59-08

FENCING OF UNSAFE PROPERTY @ 8101 STATE STREET

On a motion made by Councilwoman Bieber, seconded by Councilman Rehwaldt, the following was

WHEREAS, the Town of Royalton Building Inspector has advised the Town Board that property located at 8101 State Street, Gasport, New York, reputedly owned by David Cain, has become a potential environmental and safety concern because of, among other things, falling brickwork; and

WHEREAS, the Town of Royalton adopted Local Law No. 5 of 1981, Section 11, which deals with emergency cases and provides for the repair or removal of unsafe buildings and collapsed structures and authorizes immediate repair or demolition of unsafe buildings;

NOW, THEREFORE, it is hereby RESOLVED that, in anticipation of such demolition or repair, and given the unsafe condition of the premises, the Town Board hereby authorizes the Highway Department to erect a fence to secure the public from the threat presented by the premises and to charge said premises for the cost of same and apply same to the tax roll if unpaid. 

Town Clerk Marie L. Little, RMC, stated that all of the fire contracts have finally been signed, all of the liability certificates have been received, and all payments have been disbursed. 

Town Clerk Little passed out a copy of a letter received from the Village of Middleport regarding the Royalton-Hartland Baseball/Softball Program.  The Village of Middleport has decided to turn the administration of the program over to the board members who run the baseball program.  The Village of Middleport will provide their portion of the funding as in the past and will sign a separate contract with them.  The Village of Middleport has advised the Board Members for the Baseball/Softball League to contact the Town of Royalton and the Town of Hartland to get a written contract with each municipality for this program.  Discussion ensued regarding how this program will be insured. 

Town Clerk Little passed out copies of the bid results for the Highway Department Dump Trailer and the mowing bids for the four (4) cemeteries maintained by the Town and the mowing of the Town Hall.  The board members will have time to review them prior to the Work Session scheduled for Wednesday, April 9, 2008. 

Councilman Rehwaldt asked if the next time a Special Meeting is called, the Councilmen all be called prior to setting the time to see what would work best for everyone.  Supervisor Lang stated that he was told that four (4) out of the five (5) board members could be here.  Supervisor Lang stated that he will do that next time. 

There being no further information to come before the Town Board at this time, a motion was made by Councilman Rehwaldt, seconded by Councilwoman Bieber and carried unanimously that the meeting be adjourned at 9:35 PM.
